CNN and Zachary Young, a U.S. Navy veteran, were unable to finalize a financial settlement last week. Young alleges that CNN defamed him and his security consulting company, Nemex Enterprises Inc. He claims CNN’s November 11, 2021, segment on “The Lead with Jake Tapper” portrayed him as an exploitative profiteer, damaging his reputation and business.
Upcoming Trial in January 2025
The case is set to go to trial in January 2025. According to a filing obtained by Media Research Center’s NewsBusters, mediation efforts on September 11, 2024, failed to produce an agreement, leaving the dispute unresolved.
Potential Damages and Legal Strategy
Nicholas Fondacaro from NewsBusters noted that the amount of the settlement offer was undisclosed. However, it would need to be substantial to offset potential damages, which could exceed $1 billion. Young’s lead counsel, Vel Freedman, emphasized that the case will proceed to trial, aiming to hold CNN accountable for its actions.
Subpoena for Financial Information
Earlier this month, Judge William Henry authorized Young to subpoena CNN for sensitive financial information to assess the network’s net worth. CNN has not yet responded to requests for comment.
Details of the Controversial Segment
The segment in question featured Tapper discussing the difficulties Afghans faced in escaping the country. CNN correspondent Alex Marquardt highlighted that Young’s company allegedly charged exorbitant fees for evacuation services. Marquardt singled out Young with a photo and detailed the fees, creating a negative impression.
Allegations of Misrepresentation
Young contends that the segment misrepresented his actions by using terms like “black market” and “exploit.” The Florida First District Court of Appeal ruled earlier this year that Young provided sufficient evidence to move forward with the defamation suit.
Internal Concerns at CNN
The court found that internal CNN communications revealed concerns about the accuracy of the report. Despite these concerns, CNN aired the segment. Additionally, internal messages showed that CNN staff used disparaging language when discussing Young and his business.
